1. Who we are
ParchesNow is a platform to discover places, create plans and clubs, share what you do and buy in its store, where it brings together products from different brands and suppliers. It operates from Medellín, Colombia, and answers at the support address at the end of this document.
One account opens every surface: the website, the mobile app and any extension we publish. When we say «the platform» we mean all of them.
2. Accepting this agreement
By creating an account, signing in or using any part of the platform you accept these terms and the documents linked at the end. If you disagree with any of them, do not use the service.
If you accept on behalf of a business or organisation, you confirm you are authorised to bind it.
3. Minimum age
You need to be at least 14 to hold an account. Between 14 and 17 you also need permission from whoever holds parental authority, and that person answers for your use of the platform.
To buy in the store or subscribe to a membership you need to be 18 and legally able to enter a contract. If we find an account below the minimum age we close it and delete its data.
4. What the service includes
The platform brings different features under one account. Today these are:
- Discover: the verified place catalogue and the places the community contributes, with search, map, collections and reviews.
- Plans and clubs: create meetups, invite people, join other people's and talk in their message thread.
- Share: posts, photos, comments, reactions, friendships and profiles.
- Buy: the store, orders and paid memberships.
- Play: reputation, missions, badges, streaks and rankings.
5. The service changes
ParchesNow is under active development: we may add, change or retire features, and some open in waves. If a retired feature affects something you already paid for, «Purchases and returns» applies.
We do not guarantee uninterrupted availability. There is maintenance, and sometimes things break.
6. Your account
You can register with your email and a password, or sign in with Google. The email is verified before the account becomes active.
The account is personal and non-transferable. You are responsible for what happens under it and for keeping your password safe: if you think someone else got in, change it and write to us.
Your profile details must be true. A username gives you no rights over that word: we can reassign it if it impersonates someone or infringes a trademark.
7. The content you publish
What you publish stays yours. By publishing it you grant us a worldwide, non-exclusive, royalty-free licence —extending to the providers that host and serve the files— to store it, display it, resize or reformat it and distribute it within the platform, for the sole purpose of operating it and showing it to whoever you allow.
That licence ends when you delete the content, with two reasonable exceptions: backups, which are overwritten on their normal cycle, and whatever other people already saved or shared.
By publishing you confirm you hold the rights to what you upload —you took that photo of a place, or you have permission— and that it infringes no third-party rights.
8. Contributed places and reviews
Anyone can contribute a place or write a review. Contributions go through moderation before entering the catalogue, and can be edited or removed if the information is false, duplicated or breaks the community policies.
The verified catalogue and community contributions are different things and are shown differently. Neither is a recommendation from us: opening hours, prices and conditions come from the venue or the community and may be out of date. Check with the venue before you go.
9. Plans, clubs and in-person meetups
ParchesNow provides the tool to meet; it does not organise, supervise or attend meetups. Whoever creates a plan is responsible for it, and whoever joins does so at their own risk.
Venues are independent businesses: we do not answer for their service, prices or entry conditions.
Use common sense. Meet in public places, tell someone where you will be, and report any behaviour that makes you uncomfortable.
10. Prohibited use
You may not use the platform to:
- Carry out illegal activity, or promote or coordinate a crime.
- Harass, threaten, discriminate or incite hatred or violence.
- Impersonate a person, a business or ParchesNow.
- Publish sexual material involving minors, graphic violence or any content the law forbids.
- Publish another person's personal data without their permission.
- Send spam or unsolicited advertising, post fake or paid reviews, or run automated accounts.
- Scrape data at scale, reverse engineer the service, bypass usage limits or probe its security without written authorisation.
- Interfere with the service or with other people's experience of it.
11. Reputation, missions and credits
Reputation, levels, badges, streaks and promotional credits are internal product elements. They are not money, hold no value outside the platform, cannot be transferred between accounts and cannot be exchanged for cash.
We can adjust, freeze or remove anything earned by breaking the rules —multiple accounts, fake visits, automation— and we can change how it is earned, announcing it inside the product.
12. Memberships and subscriptions
Some features are offered as a paid membership, by the month (30 days) or by the year (12 months at the price of 10). The price, what it includes and its billing period are shown before you pay and stay visible in your account, along with your payment history. You can read prices in dollars (USD) or in Colombian pesos (COP); you are always charged in Colombian pesos (COP), for the amount in pesos you see before you pay.
Each payment covers a single period: the membership does not renew or charge by itself. Before it ends we let you know so you can renew when you want. Paying again for the same plan adds the period to what you have left; paying for another plan replaces it from that day. The membership is activated when the payment gateway confirms the payment, not when you return to our page.
You can cancel the renewal any time from your account: you keep the benefits until the paid period ends, monthly or annual.
For now subscriptions do not add VAT; if that changes, it will be shown before you pay. Price changes are announced before they apply, and always before a new payment.
13. Buying in the store
The store brings together products from different brands and suppliers that ParchesNow selects and presents. Purchases have their own document because they have their own rules: how the price is formed, who charges, when it arrives, how to return it and how the warranty works. That document is part of these terms.
14. Intellectual property
The ParchesNow brand, name, logo, design, software and databases belong to their owners. These terms transfer none of those rights to you: we grant a limited, personal, revocable permission to use the platform as offered.
If you believe something published here infringes your rights, write to us saying which content it is, where it is and what you base the claim on. We review it and reply.
15. Third-party services
The platform relies on third parties to work: the gateway that processes payments, the brands and suppliers that provide and ship the products, the service that sends email, cloud hosting and sign-in with Google. Each has its own terms and its own data processing, detailed in the privacy policy.
There may also be links to sites that are not ours. We do not answer for their content or practices.
16. Suspension and account closure
You can leave at any time from your account. Leaving erases the data that identifies you; what remains, and why, is explained in the privacy policy.
We may limit, suspend or close an account that breaks these terms or the community policies, that puts other people or the service at risk, or when the law requires it. Except in serious cases or where the law prevents it, we warn you first and explain why.
Closing an account cancels no debt in either direction: an order already paid is delivered or refunded.
17. Warranties and liability
The service is provided as is. We do not guarantee that catalogue information is accurate at all times or that the platform is free of errors.
To the extent the law allows, we are not liable for indirect damages, lost profit or data loss arising from use of the platform, nor for what happens at an in-person meetup.
None of this limits the rights Colombian law gives you as a consumer, or our liability for wilful misconduct or gross negligence.
18. Changes to these terms
We may update them. The version in force always lives at this address, with its revision date at the end.
When a change is significant we announce it with reasonable notice inside the product or by email. If you keep using the platform after it takes effect, you accept it; if not, you can close your account.
19. Governing law and claims
These terms are governed by Colombian law. Before going to court, write to us: almost everything is solved by talking.
As a consumer you keep the rights of the Consumer Statute (Law 1480 of 2011) and may turn to the Superintendency of Industry and Commerce. If you live outside Colombia, the mandatory consumer protection rules of your country still apply where relevant.
